These Terms of Service ("Terms") govern your access to and use of the DriveMint mobile application and related services (collectively, the "Service"), operated by IOup LLC ("Company," "we," "us," or "our").
By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Description of Service
DriveMint is a digital driving log application designed to help learner drivers track their supervised driving practice hours. The Service allows users to:
- Record driving sessions with supervising drivers
- Track driving duration and optionally distance via GPS
- View state-specific driving hour requirements
- Manage a list of approved supervising drivers
- Share drives between devices via QR codes (peer-to-peer, no cloud required)
- Generate driving log reports for license applications
- Receive local notifications for drive reminders and auto-pause alerts
DriveMint is not a government service, not a legal authority, and does not guarantee compliance with any state or jurisdictional requirements. Users are solely responsible for verifying that their driving records meet applicable legal and licensing standards.
2. Eligibility
By accessing or using the Service, you represent that:
- You are at least 13 years of age (or the minimum age required in your jurisdiction)
- If you are under the age of 18, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms
- You agree to comply with these Terms and all applicable laws and regulations
3. Data Responsibility
All data is stored locally on your device. You are responsible for:
- The accuracy of all information you enter
- Maintaining the security of your device
- Backing up your data
- All activity that occurs on the Service through your device
We are not responsible for loss of data due to device failure, deletion, or unauthorized access. Uninstalling the Service will permanently delete all your data.
4. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on a mobile device that you own or control, solely for your personal, non-commercial use.
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code
- Circumvent security or access controls
- Use the Service for unlawful or fraudulent purposes
- Interfere with the Service's operation or other users
- Misrepresent driving data for legal or regulatory purposes
- Copy, modify, distribute, or use the Service's name, logo, or branding without permission
Violation may result in suspension or termination of your access.
5. Safety Disclaimer
IMPORTANT: DriveMint must not be used while driving. The Service is a record-keeping tool only and does not provide driving instruction, navigation, or real-time driving assistance.
You acknowledge that:
- Start and stop drives only when the vehicle is parked. Always set up your driving session before putting the vehicle in motion.
- The learner driver must never interact with the Service while driving. Only the supervising driver or a passenger should operate the Service during a driving session.
- Driving requires full attention. Logging or interacting with the Service while driving may be dangerous.
- The Service is not a substitute for proper driver education or professional instruction.
- You assume all risks related to your use of the Service during driving practice.
We disclaim all liability related to distracted driving, accidents, injuries, or violations that occur during driving practice.
6. No Professional or Legal Advice
The Service does not provide legal, regulatory, or professional advice. We do not verify, certify, or submit driving logs to any government authority.
7. State Requirement Information
The Service displays state-specific graduated driver licensing (GDL) requirements sourced from the Insurance Institute for Highway Safety (IIHS). This information is provided for convenience only.
- State requirements are subject to change without notice
- Always verify current requirements with your state's Department of Motor Vehicles (DMV)
- We do not guarantee the accuracy, completeness, or timeliness of this information
- We are not responsible for any consequences resulting from reliance on this information
8. GPS and Location Services
If you choose to enable GPS tracking:
- Location services are used solely to calculate distance driven
- Location data is processed entirely on your device and is never transmitted to external servers
- You are responsible for ensuring GPS tracking complies with local laws
- GPS accuracy may vary based on device capabilities and environmental conditions
- We are not responsible for inaccurate distance calculations
- On iOS, background location tracking may be used to continue distance calculation when the Service is not in the foreground
9. Notifications and Auto-Pause Features
The Service includes features to help prevent forgotten drives from running indefinitely:
- Local notifications may remind you to check on active drives after extended periods
- Auto-pause may occur when GPS detects no movement for 10 minutes
- Auto-stop may occur after 6 hours of continuous driving to prevent runaway timers
- All notifications are local to your device and do not require an internet connection
- You are ultimately responsible for starting and stopping your drives accurately
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how your data is handled. All data remains on your device. We do not collect, access, or store any of your personal information. The Privacy Policy is incorporated by reference into these Terms.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF ANY INFORMATION.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IOUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DATA LOSS OR PERSONAL INJURY, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR THE SERVICE IN THE PRECEDING 12 MONTHS.
13. Indemnification
You agree to indemnify, defend, and hold harmless IOup LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Any driving activities recorded using the Service
- Inaccurate or fraudulent data entered by you
14. Dispute Resolution & Arbitration
Binding Arbitration: Any dispute arising from these Terms or the Service shall be resolved by binding arbitration, not in court, except for claims eligible for small claims court.
Arbitration Rules:
- Arbitration shall be conducted by the American Arbitration Association (AAA)
- Arbitration may be conducted remotely
- Wyoming law applies
Class Action Waiver: You agree that disputes will be resolved only on an individual basis, and you waive the right to participate in class actions or representative proceedings.
15. Intellectual Property
The Service and its original content, features, and functionality are owned by IOup LLC and are protected by international copyright, trademark, and other intellectual property laws.
16. Termination
We may suspend or terminate your access to the Service at any time, without prior notice, for any reason, including breach of these Terms. You may stop using the Service at any time. Upon termination, your license to use the Service will immediately cease.
17. Modifications to Service or Terms
We reserve the right to modify the Service or these Terms at any time. Material changes will be communicated via:
- In-app notification, where practicable
- Updated posting with a revised "Last Updated" date
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
19. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, outages, or government actions.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and IOup LLC regarding your use of the Service and supersede any prior agreements.
